“We write to object to your new policy memorandum regarding adjustment of status. Adjustment of status is the statutory process by which immigrants may apply for lawful permanent residence, often called a ‘green card,’ from within the United States,” wrote the lawmakers. “On May 21, 2026, U.S. Citizenship and Immigration Services (USCIS) issued a policy memorandum (PM-602-0199) with guidance claiming that adjustment of status is an ‘extraordinary form of relief.’ Without any basis in the law and in a departure from decades of precedent, this guidance creates a policy preference for consular processing abroad over adjustment of status in the United States, requiring applicants to meet new, undefined discretionary criteria to be processed domestically. We urge you to reverse this new policy and restore adjudications of adjustment of status applications in a manner consistent with the law, longstanding practice, and congressional intent.”

“The Merit Systems Protection Board's decision was incorrect. Article II does not permit the President to override Congress's constitutional power to pass laws governing the federal civil service. Upholding the final administrative decision would fundamentally alter the balance of power between the Executive and Legislative branches. Millions of federal workers would become removable at will—the civil service merit system would functionally cease to exist.”

We strongly push back on the Board of Immigration Appeals' (BIA) recent decision, which attempts to override protections established in regulation in 2022. By regulation, immigration judges may, in the exercise of their discretion, dismiss proceedings to protect Dreamers, and we will not allow this administration to strip that authority.

They go on to say, “The position of Immigration Judge was created by Congress pursuant to its power to “establish a uniform rule of naturalization.” As employees defined under 5 U.S.C. § 7511, Immigration Judges are entitled to the procedural protections set forth in 5 U.S.C. § 7513. The removals of Jackler and Jaroch without the protections of 5 U.S.C. § 7513 is therefore contrary to the will of Congress. And the President’s removal power under Article II cannot ‘disable’ Congress from enacting a reasonable restriction on the removal of employees whose duties mirror tremendous swaths of the civil service.”

Congress intended contract vehicles such as the Worldwide Expeditionary Multiple Award Contract (WEXMAC) to give DOD exceptional authority to provide accelerated and flexible logistical and support services to U.S. expeditionary forces around the world. “Immigration enforcement against child care workers not only impacts the child care sector but also risks second-order effects for American families’ employment. When child care is disrupted, many parents must cut work hours or leave the workforce altogether to care for children. One study estimated that, from February to July 2025 alone, the “doubling of ICE arrests led to about 77,000 fewer employed U.S.-born mothers.” Already, child care is one of the most burdensome expenses for American families. Nationwide, families spend an average of more than $13,000 each year on child care, and up to almost $30,000 in some states. And even when families can afford child care, these services are in short supply; more than half of parents report waiting months for available slots. “The military’s expanded use to support immigration operations and domestic law enforcement activities at home is fundamentally un-Constitutional, dangerous for American civil rights, and risks straining military readiness and resources, weakening troop morale, undermining recruitment and retention, and eroding public trust in the military,” the senators wrote in their letter to the U.S. Department of Defense Acting Inspector General Steven Stebbins.  “Neither the active-duty military nor the National Guard are intended or trained at scale for the purposes that the Administration has claimed they are used for, including ‘crime-fighting’.”

“Deploying our military to one of our own cities is a scare tactic, a waste of resources, and a constitutional crisis. The President is abusing his role as Commander in Chief and threatening multiple rights guaranteed in our Constitution aimed to protect us from dictatorship.  “Americans overwhelmingly support providing Dreamers a path to citizenship, and in December 2024, then-President-elect Trump stated that he supported protections for Dreamers to remain in the United States. The Fifth Circuit Court of Appeals kept in place a stay that protects current DACA holders and limited a nationwide injunction on new DACA approvals to the state of Texas. In June, 41 Senators sent United States Citizenship and Immigration Services (USCIS) a letter requesting that USCIS begin processing new DACA applications, consistent with these decisions. Instead of doing so, DHS has issued a statement urging DACA holders—who know no home but the United States—to ‘self-deport.’ It was also disturbing to see DHS recently waste taxpayer dollars on the prolonged detention of a deaf and non-verbal DACA holder with no criminal history, contrary to your claims that the Trump Administration is arresting the ‘worst of the worst.’”
