Supreme Court opens door for more deportations

On Tuesday, the Supreme Court lifted a stay on President Trump's policy to deport illegal aliens to safe third countries. This marks the third time the nation's highest court has overturned a ruling on the matter from U.S. District Judge Brian Murphy of Boston. The Court's decision allows the administration to restart safe third-country deportations and confirmed that oral arguments before the Supreme Court will be heard in December.

The policy largely affects the removal of illegal aliens from recalcitrant countries—those that refuse to repatriate their nationals who have final deportation orders. The list includes China, Cuba, Iran, Venezuela, and others. The Trump Administration has negotiated agreements with dozens of countries in Central America and Africa to accept these third-country removals.

Solicitor General John Sauer stated that the policy is essential for removing criminal aliens. The administration says it has used it to deport thousands of illegal aliens whose home countries refused to take them back.

While the Supreme Court's decision aids the administration's mass deportation efforts, a New York federal judge issued a nationwide stay this week prohibiting Immigration and Customs Enforcement (ICE) officers from making arrests at immigration courts. ICE officers have been detaining illegal aliens at courthouses because it is safer for both the officers and the aliens, since the aliens are unarmed and in a controlled environment. Federal Judge Kevin Castel, a George W. Bush appointee, issued the stay, ruling that the policy allowing such arrests was "arbitrary and capricious."

Vance Exposes H-1B Visa Program

In an interview with Real America's Voice, Vice President JD Vance called the H-1B visa program "completely broken" and expressed support for eliminating it altogether.

Climbing 📈in the immigration rankings

Rep. Bob Onder (R-MO) climbed 29 spots in IAP Action’s Immigration Rankings this week after cosponsoring three bills, including two that address birthright citizenship. He now ranks 73rd overall in the House.

Rep. Onder cosponsored the Birthright Citizenship Act, H.R. 569, which would end the automatic granting of citizenship to children born to parents who are not citizens, legal permanent residents, or service members actively serving in the armed services. He also cosponsored the Birthright Citizenship Clarification Act, H.R. 9633, which ends the granting of automatic citizenship to children born to illegal-alien parents. IAP Action supports both bills and has designated H.R. 569 as key legislation.

He also cosponsored the Stopping Border Surges Act, H.R. 116, which would close the loopholes exploited by illegal border crossers during the Biden Border Crisis. IAP Action supports the bill and has designated it as key legislation.

Sliding 📉in the immigration rankings

Rep. Bill Foster (D-IL) dropped seven spots in the rankings this week after cosponsoring the Protect American Values Act, H.R. 10045. The bill would block federal funds from being used to implement President Trump's efforts to enforce the Public Charge statute. IAP Action opposes the bill. Foster now ranks 329th overall in the House.

Sen. Mazie Hirono (D-HI) dropped three spots after cosponsoring the Renewing Immigration Provisions of the Immigration Act, S. 2468. The bill would grant amnesty to millions of illegal aliens. IAP Action opposes the bill and has designated it as key legislation. Sen. Hirono now ranks 97th in the Senate.

Next Week

The House and Senate have left town in preparation for the midterm elections. October will be quiet on Capitol Hill, so IAP will be focused on preparing for the lame duck when Congress returns in November.
