The NO BAN Act

This bill severely restricts the broad authority found in 8 USC 1182(f) (212(f) of the INA), which allows the President to prohibit the entry of any alien or class of aliens or place any restriction deemed necessary if in the national interest. The bill not only limits the extent of the use of the power, it requires a briefing and report to Congress within 48 hours of a 212(f) proclamation (otherwise the restrictions terminate), and allows for judicial review. Further, the bill requires a report on the uses of the proclamation authority under President Trump and requires similar reports every 30 days when the power is used in the future. Otherwise, the authority terminates.
