H.R. 9745: Orlin's Law

Orlin's Law 

This bill restricts the detention and removal of illegal alien parents by establishing a statutory presumption in favor of their release and expanding taxpayer-funded support services. It-

• Requires the release of any detained alien who is a parent unless ICE can demonstrate by "clear and convincing evidence" before an immigration judge that the alien poses and unmitigatable safety risk;
• Mandates that DHS inquire about parental status within 2 hours of taking an alien into custody and release covered parents onto supervised release or community-based programs rather than maintaining ICE detention;
• Expresses the Sense of Congress that family units should qualify for humanitarian parole and establishes a new DHS community-based case management program to provide housing, transportation, medical care, and legal services;
• Directs immigration judges to appoint taxpayer-funded legal counsel to covered illegal alien parents during family integrity custody review proceedings; and
• Strictly limits ICE's ability to transfer detained parents outside their initial area of custody, mandates free daily telephone and video calls, establishes an Office of Detained Parent Coordination within ICE headquarters, and requires government-funded reunification within the United States if removal protocols are not fully met.
