Restoring American Citizenship Act of 2026
This bill:
Amends Section 301(a) of the Immigration and Nationality Act to replace the phrase "subject to the jurisdiction thereof" with "not subject to any foreign power" for purposes of acquiring birthright citizenship;
Deems a person born in the United States to be "subject to a foreign power" (ineligible for automatic birthright citizenship) if neither parent is a U.S. citizen or a lawful permanent resident at the time of the birth, ending birthright citizenship for the children of illegal aliens, parolees, and nonimmigrants;
Deems a person to be born "outside, not in, the United States" if both parents are applicants for admission under Section 235(a)(1), denying birthright citizenship to children born to illegal aliens who entered without inspection or aliens who are paroled into the country; and
limits the applicability of these provisions prospectively to individuals born on or after the date of enactment and includes a severability clause.
