BACK OFF Act

This bill is focused on stopping birth tourism. It-

  • Designates birth tourism as a ground for the inadmissibility and deportation of aliens, explicitly barring any authorization for waivers or parole;

  • Mandates the temporary detention and medical examination of any alien who is a biological female of childbearing age to determine if she is likely to give birth on United States soil;

  • Establishes an expedited administrative removal process for aliens suspected of birth tourism and strips federal courts of judicial review over any associated findings or actions;

  • Enforces automatic 180-day visa pauses and total admission bans against recalcitrant countries that fail to accept a deported alien within 14 days;

  • Criminalizes the knowing facilitation of birth tourism, including providing housing, transportation, food, or financial support, as well as committing healthcare fraud, subjecting violators to mandatory minimum prison sentences of 10 years; and

  • Creates a specialized Birth Tourism Taskforce within the Department of Homeland Security to investigate fraud networks, coordinate with local law enforcement, and refer cases for federal prosecution.
