Protect America Act

This bill:

  • Blocks covered federal funds from DHS, DOJ, HUD, and DOT for state and local governments that adopt or maintain sanctuary policies; 
  • Requires federally funded detention centers to determine the citizenship status of detainees, notify ICE of noncitizens within 24 hours, and honor ICE detainer requests;
  • Grants a private right of action to victims (or their families) of serious violent felonies committed by removable aliens, allowing them to sue jurisdictions if a sanctuary policy materially impeded federal immigration enforcement;
  • Prohibits the issuance of F-visas and M-visas for international students to attend academic or vocational institutions located within sanctuary jurisdictions; 
  • Increases criminal fines and prison sentences for both offenses, and requires mandatory, no-release pre-trial detention for aliens charged with illegal entry;
  • Criminalizes the use of loud noises (such as whistles or megaphones) to intentionally interfere with federal officers performing their official duties, and increases the mandatory minimum prison sentences for assaulting federal officers; and
  • Amends the Internal Revenue Code to revoke the 501(c)(3) tax-exempt status of charitable organizations that promote, incite, or provide material support for criminal violence.
