Visa Cap Enforcement Act

This bill:

  • Requires H-1B workers to be counted against the annual numerical cap if their authorized stay continues beyond three years;
  • Eliminates the annual numerical cap exemption for colleges and non-profit organizations;
  • Removes exemption from the numerical cap for aliens who change status to H-1B; and
  • Counts aliens who change employers against the annual numerical cap.
