Kate's Law

This bill seeks to amend the Immigration and Nationality Act by increasing criminal penalties for individuals who illegally enter and reenter the United States after being removed. The legislation raises the maximum imprisonment for a first-time illegal entry from 2 years to 5 years and establishes a new mandatory minimum 5-year prison term for aliens who enter illegally and are later convicted of a crime punishable by more than one year. For aliens who reenter after a prior removal, the bill sets a general penalty of up to 10 years imprisonment and creates a mandatory minimum 10-year sentence if the alien was previously convicted of an aggravated felony, any other felony, or any crime punishable by more than one year in prison.
