OPEN Act

This bill-

  • Prohibits ICE and CBP from executing civil immigration arrests or detentions without a judicially enforceable warrant signed by an Article III judge or magistrate, effectively ending the use of routine administrative warrants and bringing standard field operations to a halt;
  • Establishes a strict statutory mechanism allowing illegal aliens to suppress all evidence of their alienage and force the termination of their removal proceedings if any technical warrant or procedural violation occurs during enforcement;
  • Imposes severe regulatory hurdles, mandatory pre-operational audits, and local political consultation requirements before DHS can repurpose existing warehouses or correctional facilities into new detention spaces; and
  • Details extensive statutory requirements for detainee transit and conditions, including unannounced visits by Members of Congress.
