DHS Use of Force Oversight Act

This bill-

  • Requires a department-wide policy ensuring that law enforcement officers (such as CBP and ICE) use only force that is "objectively reasonable" and mandates verbal warnings before use of force when feasible;
  • Prohibits restraints like chokeholds and carotid restraints;
  • Mandates deescalation tactics;
  • Requires each DHS component to establish a "Use of Force Review Council; and
  • Requires biannual reports and congressional notification within 24 hours of cases involving hospitalization or death.
