Strengthening Our Workforce Act of 2025

This bill creates conditional lawful permanent resident status amnesty (which means a status as a nonimmigrant with a period of stay of 2 years, with employment authorization to be provided concurrently). At the end of the two years, the lawful permanent residence condition is removed, without regard to numerical limitations. 

Eligibility: 

Aliens are eligible if they:

  • Apply and pay fees as required by the Secretary;
  • Are continuously present as of January 1, 2024, whether unlawfully, under DACA, or with status as a nonimmigrant with employment authorization;
  • Have worked in a "covered profession" for 100 cumulative days at any time; and
    • This includes, but is not limited to: health care, emergency response, agricultural work, hotel/retail, and construction.
  • Are not inadmissible under paragraph (1), (6)(E), (6)(G), (8), or (10) of section 212(a), also found at 8 U.S.C. 1182, which enumerates grounds of inadmissibility.
    • Even for the enumerated grounds of inadmissibility, the law makes them subject to waiver for humanitarian purposes, for family unity, or because the waiver is otherwise in the public interest.
    • Inadmissibility provisions automatically waived: health-related issues, engaging in alien smuggling, abusing a student visa, being ineligible for citizenship, or for miscellaneous grounds such as practicing polygamy, international child abduction, and unlawful voting.

Adjustment of Status:

Aliens are adjusted to lawful permanent resident status at the end of the two-year conditional lawful permanent status, unless they object in writing and if they pay a fee as determined by the Secretary and pass a background check.
