Agriculture Workforce Reform Act of 2025

This bill establishes a three-year amnesty program for illegal aliens who worked for at least 2 years in agriculture, departed or were removed, subsequently seek admission as an H-2A to work in agriculture, and pay a fee (at least $2500 per illegal alien and $2500 per petitioning employer). Not only are the covered aliens not removable for their unlawful presence, but they are immune from prosecution for previous illegal reentry or illegal entry, and their employers are immune from illegally employing them.

While the H-2A visa is strictly limited to temporary or seasonal agriculture (and generally means aliens receive visas for up to a year), this bill grants the amnestied aliens 3-year visas (with 3-year renewal periods) to work in agriculture regardless of whether or not the work is temporary or seasonal, which means industries like dairy will get access to the amnestied guestworker program.
