Department of Homeland Security Appropriations Act, 2026

While this bill primarily funds the Department of Homeland Security at similar levels to the previous year, it includes several provisions regarding immigration:

  • Allows reprogramming of funds for ICE Detention;
  • Requires the prioritization of aliens for removal (in contrast to the removal of all aliens;
  • Blocks the detention of citizens (which could include those interfering with lawful immigration enforcement);
  • Increases H-2B temporary or seasonal non-agricultural work visas for FY26 to over 238,000 (from 66,000);
  • Adds dairy workers to the unlimited H-2A program;
  • Adds carnival workers to the unlimited P-visa program;
  • Improves the credible fear standard; and
  • Limits asylum for aliens who transited through safe third countries;
