H.R. 10799 - Protecting American Workers Through H–1B Modernization Act

This bill amends the Immigration and Nationality Act to increase the statutory salary threshold for "exempt H-1B nonimmigrant" aliens from an outdated $60,000 to not less than twice the national average wage index, requiring H-1B-dependent employers to pay substantially higher wages before being excused from American worker recruitment and non-displacement attestations. However, by leaving the parallel master's degree exemption completely untouched, the measure allows staffing agencies and foreign outsourcing firms to easily bypass this wage floor and continue displacing American workers with cheap guestworkers.
