America’s College Promise Act of 2026
This bill:
Prohibits States and participating institutions from denying federal-state partnership grant benefits, including $0 community college tuition and taxpayer-funded living stipends, to any individual on the basis of citizenship, alienage, or immigration status, guaranteeing tuition-free higher education to illegal aliens;
Bypasses federal restrictions under 8 U.S.C. § 1623 and state residency requirements by defining eligible community college students to include aliens who would qualify for in-State or in-district resident tuition rates but for their unlawful immigration status;
Establishes a double standard that enforces the requirement to file a Free Application for Federal Student Aid (FAFSA) exclusively on United States citizens, exempting aliens and illegal aliens from federal financial aid disclosure mandates; and
Expands Title III institutional tuition-reduction grants at Historically Black Colleges and Universities, Tribal Colleges and Universities, and Minority-Serving Institutions to illegal aliens by redefining "low-income student" to encompass individuals who meet financial eligibility criteria but are statutorily barred from receiving Federal Pell Grants due to their unlawful immigration status.
