SMARTER Act

This bill:

  • Eliminates the Visa Lottery;
  • Narrows the family immigration category to 88,000 annually, minus parolees;
  • Creates a board to determine the cheap labor needs of industry and set aggregate nonimmigrant employment visa numbers (adjustments up to 10% annually);
  • Develops a points system for employment immigration;
  • Expands the H-1B program to allow cheap foreign labor to compete for more jobs against American workers (allows for annual board adjustment); and
  • Creates a "Gold Card" visa with 25,000 available from 2026-2035 for aliens able to purchase immigration status for $1 or $2 million dollars.
