Birthright Citizenship Act of 2024

This bill would end the practice of automatically granting citizenship to the children of illegal aliens and temporary visitors. Currently, most newborns receive citizenship even if both parents are in the country illegally.

Under current federal lawcitizenship is automatically granted if the child is born in the U.S. "and subject to the jurisdiction thereof." Children born in the U.S. to certain foreign officials are not considered "subject to the jurisdiction" and are not eligible for citizenship.

This bill would require that at least one parent be a U.S. citizen, lawful permanent resident, or a nonimmigrant actively serving in the military, for a child to be eligible for automatic citizenship at birth.
