This bill codifies Alternatives to Detention and restricts it to when 1) all detention beds are filled; 2) there is no other option to hold aliens in detention; and 3) the Secretary has exhausted all reasonable efforts to hold aliens in detention. It requires GPS tracking of all aliens in the nondetained docket, and requires removal orders in absentia in cases where an officer provides an immigration judge with an affidavit showing that an alien failed to comply with a condition of release.
